Unmarried couples are the largest growing type of family at the current time. Many people misunderstand their entitlements upon separation. Our family team regularly advises on these issues.
The laws relating to cohabiting couples separating and their potential financial claims are very different to those available upon divorce. Such claims would be based on Children Law or Property and Trust Law.
A former cohabitee cannot claim maintenance for themselves nor make a claim against any property owned by their former partner just by virtue of the fact that they used to live together. Any claims available are determined by property law.
Where the parties have children certain claims can be made to postpone a sale of a property whilst the children still need the property as a home. However, it would depend on the size of the property, its value and the circumstances of the parents.
