Our family team are able to offer collaborative law as a way of resolving all types of family related disputes without issuing Court proceedings.
The process is designed to resolve matters amicably for the benefit of the family. Each party has their own collaborative solicitor but rather than negotiations taking place by letter or over the phone negotiations take place over a series of round table meetings attended by both parties and their collaborative solicitors.
A key element of the collaborative law process is the participation agreement that all parties sign at the start of the process. This agreement states that neither party will issue proceedings. The agreement also states that if an agreement is not reached and proceedings are issued both parties have to obtain new solicitors as their existing ones are not permitted to act under the agreement. This helps everybody concentrate their minds on reaching an agreement as you do not want to have to start again with a new solicitor. A divorce petition can be issued by agreement but nothing else.
The process is not for everyone .You have to be open and honest and want an agreement that works for everyone not just yourself.
