Enduring Powers of Attorney were replaced by Lasting Powers of Attorneys in October 2007.
Any Enduring Power of Attorney made before 30 September 2007 will continue to be valid and can be used by the appointed Attorneys in relation to decisions about property and financial matters.
An Enduring Power of Attorney can be used as soon as it is required however, in order for it to remain valid it must be registered with the Office of the Public Guardian as soon as donor “has become or is becoming incapable” of dealing with their own financial affairs.
If you are an Attorney appointed under an Enduring Power of Attorney in need of guidance on how to register the document with the Office of Public Guardian or on the types of decisions that you are allowed to make please contact one of our team who will be happy to help.
