What is an Enduring Power of Attorney?
An Enduring Power of Attorney is a legal document that was used before 1 October 2007 to allow someone (the “Attorney”) to manage another person’s property and financial affairs if they lost the ability to do so themselves.
Although EPAs have been replaced by Lasting Powers of Attorney, EPAs made before the cut-off date are still valid. However, to continue using one when the donor begins to lose capacity, it must be registered with the Office of the Public Guardian.
Why You Might Need Support with Your EPA
Managing an EPA, particularly when capacity is decreasing, can raise important legal questions, such as:
- How and when to register an existing EPA
- What decisions an Attorney is lawfully permitted to make
- When legal authority actually begins
- What happens if the document needs updating or replacement
Whether you’re an Attorney appointed under an EPA, or you’re considering what options are available, our solicitors provide clear, trusted guidance at every step.
How Our Solicitors Can Help with EPAs
Our specialist solicitors can assist with:
EPA Registration with the Office of the Public Guardian
We’ll support you through the EPA registration process, helping to ensure that the document is registered correctly once a donor’s capacity is diminishing, so that legal authority is secure and safe.
Understanding Attorney responsibilities
We explain what decisions you can and cannot make under an EPA and how to act in the donor’s best interests as the law requires.
Transitioning to a Lasting Power of Attorney
If you need broader authority, for example, to make decisions about health and care, then an EPA alone may not be sufficient. We can advise when a Lasting Power of Attorney (LPA) is appropriate and help you set one up if needed.
Ongoing support and review
Life changes, and so might your legal needs. We can review existing arrangements and help ensure they continue to protect the donor and those acting on their behalf.
