The Regulatory Reform (Fire Safety) Order 2005 came into force on the 1st October 2006. The Order is comprehensive and outlines duties that are applicable to many.
In most cases the enforcing authority will be the fire and rescue authority for the area. If those with a duty do not comply with the order they could find themselves facing investigation, on the receiving end of an enforcement, alteration or prohibition notice and possibly prosecution.
These matters are dealt with in the criminal courts, and if prosecuted and convicted, a duty holder could face anything from a fine to a term of imprisonment. These offences do not just apply to individuals, they apply to body corporates too, and so a company could face investigation or Prosecution
