Choosing Your Executors

Careful consideration should be taken when deciding who to appoint as your Executor(s).

They will be the representatives of your Estate and carry out the wishes you have specified in your Will. It is, therefore, an important decision as your Executor(s) should be trustworthy and act in the best interests of your Estate.

When Should You Consider Independent Executors?

If you are concerned about conflicts or disputes arising it may be prudent to appoint Independent Executors to avoid matters becoming contentious following your death.

An Executor must act in good faith and must not place themselves in a position where their duty and interest may conflict.

The Executors are responsible for all that they do, or fail to do. An Executor may be held personally liable for any loss resulting from a breach of their duty, even if the mistake is unintentional.

What Does an Executor Do?

Usual responsibilities of an Executor can include:-

  • Notifying the relevant financial organisations and collating Estate information;
  • Applying for a Grant of Representation, known as a Grant of Probate;
  • Dealing with the payment of Inheritance Tax, Income Tax, and Capital Gains Tax returns, if necessary;
  • Establishing whether there are any claims against an estate;
  • Settling all debts and liabilities;
  • Preparing Estate Accounts;
  • Notifying the beneficiaries named in a Will;
  • Dealing with and paying any legacies;
  • Distributing the remaining funds in the estate to the named beneficiaries named in the Will.

Executors and Trusts

The responsibilities of Executors continue for any ongoing Trusts created by the Will. For example, where money has been left to children who are under 18 years of age. It is usual for the Trustees to be the same people appointed as executors in the Will. If trusts are created, more than one Trustee needs to be appointed.

Can an Executor Refuse to Act?

It is possible ‘renounce’ as an Executor and refuse to act on behalf of the Estate, provided the Executor has not already started to do any work in the administration process.
